Governor Martin O'Malley says lawmakers in 2012 will have to have the "courage" to consider tax hikes as well as spending cuts, and that includes an increase in the state's gasoline tax.

At a briefing for reporters in Annapolis today, O'Malley said lawmakers have already cut $6.8-billion in spending over the last four years.

He says more money is needed for road and bridge projects.

He notes that the state's 23.5-cent-a-gallon gasoline tax was set in 1992 when gasoline was selling for more than $1.10 a gallon. Regular now sells for more than $3 a gallon. He notes that gas tax revenue has not kept up with rising costs of infrastructure projects.

Earlier this year, a commission recommended a 15-cent-a-gallon increase in the gas tax over three years.

The General Assembly already has a pile of 47 bills that have been prefiled so members can get right to work when they convene next month.
On the House of Delegates side, nobody has prefiled more than Del. Michael Smigiel.

Smigiel, R-Cecil, is well known for being a prolific pre-filer. For the 2012 session, 12 bills that Smigiel has sponsored are already prepared for consideration.

“I do it for tactical and practical reasons,” he said.

A pre-filed bill is one that is drafted and submitted for consideration early. These bills are already numbered and available to be read on the General Assembly website. Any sitting member of the legislature could prefile for this session, but according to the Maryland Code, drafting requests were due by Nov. 15, and the bills had to be submitted by Dec. 2.

Smigiel’s prefiled bills are all over the map in terms of what they would do. They vary from amending the Maryland Constitution to establish a Victims’ Bill of Rights to automatically presuming that a person applying for a handgun permit has a good reason to wear, carry or transport the weapon.
He is also the House of Delegates’ torchbearer for several well-publicized Republican bills, like requiring PlanMaryland to receive legislative approval before it becomes law, and increasing public notice and comment for toll increases. The majority of them are new to this legislative session.

Maryland Senator Joe Getty: Pre-Session Events This Week


The 2012 Session of the Maryland General Assembly begins on Wednesday, Jan. 11, with the opening session in the Senate Chamber commencing at noon.

Many pre-session events will be occurring this coming week and you are invited to participate.

Tomorrow (Jan. 3,) the Carroll County Chamber of Commerce will host its annual legislative breakfast. Our local legislative delegation will be discussing the many challenges and issues for the upcoming session. The breakfast begins at 8 a.m. at the Best Western Conference Center (for additional information, click here).

On Wednesday, Jan. 4, I will be hosting a "Town Hall" meeting in Hampstead to outline the impact of redistricting at the federal, state and local level. The meeting is open to the public and will be held at 7 p.m. at J&P Pizza, 903 S. Main St., in Hampstead.

On Thursday morning, Jan. 5, I will be the featured speaker at the Carroll County Ag-Business breakfast. This group meets monthly for an 8 a.m. breakfast at Baugher's Restaurant in Westminster.

I will also be speaking on Thursday afternoon to the section chairs of the Maryland State Bar Association about the legislative process and legal issues that will be prominent in the 2012 session.

With regard to state legislative redistricting, we will learn on the first day of session exactly what the new districts for State Senate and House of Delegates will look like. It is expected that Gov. O'Malley will make few minor adjustments to the plan that was released last month by the Governor's Redistricting Advisory Committee.

This new state legislative redistricting plan proposed major changes to my district - State Senate District 5. On the negative side, I will lose the northern portion of Baltimore County which I greatly enjoy representing.

On the positive side, the district will be located entirely within Carroll County thus restoring a full Senate district that existed under Gov. William Donald Schaefer's redistricting plan in the 1990s but was removed by Gov. Parris Glendening's 2002 redistricting map.

I look forward to my re-election campaign in the new district and the opportunity to meet and represent a new constituency in the State Senate. Obviously, I need to raise campaign funds now to introduce myself to the citizens in the new district. Sen. Joe Getty will be hosting a Town Hall Meeting on Wednesday, Jan. 4, to discuss with constituents the status of federal, state and local redistricting that is occurring this year. The meeting is open to the public and will be held at 7 p.m. at J&P Pizza, 903 S. Main St., in Hampstead.

Major changes were proposed by Gov. Martin O'Malley for Carroll County and northern Baltimore County in the alignment of both congressional districts and state legislative districts. Getty will begin the meeting with an update of these maps illustrated through a power-point presentation.

Getty will also discuss recent developments including the decision released last Friday by the three-judge panel considering the challenge in federal court over the state's congressional redistricting plan that was adopted by the Maryland General Assembly in October. The judges upheld the plan of Gov. O'Malley which moved Carroll County out of the 6thCong. District.

Carroll County will now be split between Cong. District 1 and 8. Hampstead and Manchester will be part of a northern and eastern portion of Carroll County that will share a district with the entire Eastern Shore. The remainder of Carroll County and a large portion of Frederick County is moved into Cong. District 8 which is primarily in Montgomery County.

In upholding the congressional redistricting plan, the federal court determined that the changes to Maryland's districts were done for the purpose of gaining a Demcratic partisan advantage. For example, the removal of 100% of Carroll County from the 6thCong. Dist. was clearly part of a design to dilute conservative voters of the existing district and create an opportunity for a Democratic candidate to win in the newly-configured district.

However, the court held that the Supreme Court has not provided a basis for lower courts to overturn state plans based upon "partisan gerrymandering." In a concurring opinion, Judge Roger Titus of the federal three-judge panel wrote: "it is clear that the plan adopted by the General Assembly of Maryland is, by any reasonable standard, a blatant political gerrymander. If the claim had been pressed by the Plaintiffs and an acceptable standard existed for judging it, I would not have hesitated to strike down the Maryland plan."

Getty will also outline how Gov. O'Malley's redistricting plan that provides for realignment of Maryland's 47 Senate districts and 141 member of the House of Delegates will affect local residents. A hearing was held in Annapolis last Thursday on the state map recommended by the Governor's Redistricting Advisory Committee.

The final plan will be introduced by Gov. O'Malley on the opening day of the General Assembly session on January 11, 2012. The plan becomes law 45 days later unless the Senate and House adopt a different redistricting plan.

Finally, Getty will also discuss the recommendations by the committee that has prepared a report on the 5 districts for Carroll County Commissioners.

The Democratic congressional redistricting plan upended Rep. Roscoe Bartlett’s (R) 6th District, transforming it from a safely Republican seat to one that will likely elect a Democrat. The feisty Bartlett, who will be 86 at the time of the next election, defiantly said he would seek an 11th term in 2012 regardless of how his district is drawn. But, is his decision changing?

Earlier in the week, it was reported that the congressman’s chief of staff, Bud Otis, was contacting key opinion leaders, testing the waters for his own run for Congress in the new 6th. He was telling people that he would run only if Mr. Bartlett decided to retire. Just yesterday, however, he resigned his position in order to begin the campaign. For his part, Rep. Bartlett still says he’s running. It appears Otis is, too.

These recent moves have prompted Maryland Republican Party chairman Alex Mooney to also enter the congressional race. Mooney served two terms in the Maryland Senate, but surprisingly went down to defeat in 2010, in the most Republican of years."

Carroll County's Delegation to Annapolis was presented this week with a pre-holiday wish list of proposed legislation — some old, some new — to introduce during the 2012 General Assembly.

At a hearing on Dec. 13 at the County Office Building in Westminster, local officials and residents offered their input on bills that would specifically impact Carroll County.

Carroll County turnout low in today’s Maryland primary

In spite of the nearly perfect weather, various reports throughout the state and Carroll County indicate that voter turnout for today’s Maryland primary election, is low.

For much of the day the temperature was in the low seventies.  There were blue skies and plenty of sunshine; the only thing missing was voters.

There were only a handful of campaign polling place workers at the Westminster Elementary School Precinct 7-7 polls in Carroll County at around 3:15 pm. 

And there were more campaign signs that campaign workers, election judges and voters.

The unopposed Republican candidate for register of Wills, Paul G. Zimmerman, stopped by to chat with Marcus Lee Primm, a campaign worker for Republican commissioner candidate for District 3, Dave Roush, and several other poll workers.

Primm said that this was really the first campaign he has ever worked-on and he has found the experience rewarding.

Zimmerman said, “I’ve been a whole bunch of places (today) and (voters are) just trickling-in.  I’ve just returned from (the polls at) at Carrolltowne (Elementary School, precinct 5-4 in the Freedom District) and they had 660 voters or so around 2 p.m…  South Carroll (High School, precinct 14-2, Berrett District was) fairly consistent.  Always someone coming in at around 10 a.m.”

Bryan Sears, reporting for Explore Baltimore County, said that the First Congressional District (mostly on the eastern shore of Maryland) had the best early voting turnout in the area where almost 4 percent of voters participated in the precincts that make up that district.  That's about a full percent higher than the Baltimore County and state turnout.

Similar reports of low voter turnout filtered in from Howard and Baltimore County.

In an e-mail interview late this morning with former Carroll County Delegate Joe Getty – a longtime political observer and Republican Maryland Senate candidate for District 5 in Carroll and Baltimore County – he commented on voter turnout: “I’m not sure that you can judge this election as being ‘low turnout’ just because of the lunchtime numbers. 

“Unlike other Maryland primaries, today’s election suffers from a “Raven’s effect” – a Monday-night football game before the Tuesday election. 

“Those Carroll County football fans may not have been able to get an early start this morning – but instead will vote on their way home from work this evening. Republican turnout four years ago was 28% - we may get close to that with the evening voters added to the 1% early voters.”

Richard Cross, former Ehrlich speechwriter and GOP political analyst, observed, “In a primary election, low turnout benefits challengers in a year where a strong anti-incumbent wave is present.

“Only the most passionate voters show up during a primary.  Passion is less inclined to be felt by supporters of candidates whose victory is a foregone conclusion.

“In the GOP gubernatorial primary, for example, many of Bob Ehrlich’s backers know he’s going to win, and are waiting for the chance to vote for him in November.  Brian Murphy’s supporters are motivated by ideology, or because they want to send Ehrlich a message before voting for him in November.”

Meanwhile, Jay Voight, one of the chief judges for the 7-7 precinct in Westminster, said that voter turnout was “slow – 12 percent – very low.  Very slow morning.”

Voting at 3:15 p.m was a breeze.  There were no lines and many more election judges than voters.  The judges were more than happy to stop and chat.  Most election polling places in Carroll County are often the scene of a community reunion and get-together on election day.  But not today.

A unit judge, Mary Lathroum, noted, “people have been coming in at a trickle.”

Karen Fassett, another election judge at Westminster Elementary School, stopped for a moment while discussing the turnout with fellow judges, Joe Shaw and Gerry Wiseman.

Fassett reported that by 3:15, 509 had voted, out of 3,672 on the voting rolls in the precinct.

Clearly Martin O'Malley and the Maryland Democratic Party have moved from fear to desperation. They spent millions of dollars spinning lies about Bob Ehrlich only to drop precipitously in the polls.

So what is their response? Double down on the very actions that brought them to this point.
O’Malley surrogates are 
harassing small business owners.
And now, instead of passive surveillance, Democrat operatives are acting as 
outright provocateurs.

Of course, Salazar doesn’t mention that it was O’Malley who tried to strong arm state businesses into more draconian unemployment insurance regulations during the 2010 legislative session. To their credit the business community stood up to O’Malley and fought off his attempts to screw them yet again.

Salazar, you’ll recall was the guy, who back in January 
slandered hundreds of tea party protestors as racists.

We are witnessing the actions of an arrogant Democratic monopoly desperate to hold on to power.

On a side note, O’Malley spokesman Rick Abruuzzese flat out lied when he said the O’Malley campaign has not been tracking Ehrlich. Here is a photo of an
